Cashin, once dubbed "Wall Street's version of Walter Cronkite" by The Washington Post, was a regular on CNBC, delivering stock market commentary and analysis to the business news channel's viewers for more than 25 years. His Wall Street career spanned more than six decades. "It is with a heavy heart that I inform you of the passing of Arthur Cashin, Jr., a true giant in our industry," Bill Carroll, head of sales and development at UBS Wealth Management USA, said in a memo sent to employees on Monday. The memo did not say when he had died or give details about the circumstances. In addition to his role at UBS, Cashin was renowned for his daily newsletter, Cashin's Comments, which was published for over 25 years with a daily circulation of more than 100,000 readers. He was also a regular on CNBC's "Art Cashin on the Markets," a segment airing several times a week over more than two decades. "It's fair to say that over this time, Art Cashin became a household name for investors across the country, who benefited from his savvy insight on the markets, good humor and wit," the memo said. Arthur D. Cashin was born in Jersey City, New Jersey, in 1941, according to CNBC. He began his business career at Thomson McKinnon in 1959 and in 1964, at age 23, he became a member of the NYSE and a partner of P.R. Herzig & Co. In 1980, Cashin joined investment bank PaineWebber and managed their floor operation. PaineWebber was acquired by UBS in 2000. At that time, the NYSE floor was the hub for the vast majority of trading activity in the United States. His newsletter, which combined market analysis with trivia, historical tidbits and even recipes, often generated a buzz in Wall Street's trading rooms and on the NYSE floor. "The day Cashin's Commentary was released was always a landmark on the Street," said Art Hogan, market strategist at Baird Wealth Management, who got to know Cashin during the several decades they worked on Wall Street together. One recipe regularly featured was for "White Castle burger stuffing", which he usually sent ahead of Thanksgiving, Hogan recalled. Its ingredients? The bun and patty from a hamburger bought from budget restaurant chain White Castle. Cashin was also a regular at Bobby Van's Steakhouse in Manhattan, where for decades he and a group of friends would gather to tell stories and discuss markets. His usual drink was a Dewar's on ice, and the restaurant would have his first ready for him within five minutes of the closing bell ringing. "Every time I'd be in New York, I'd be sure to be at Bobby Van's right when the markets closed," said Julie Werner, an individual investor in the Atlanta area, who first met Cashin back in the mid-1990s when she was taking classes at the NYSE. "They'd have his drink ready and waiting for him at his own seat." Cashin was one of three senior executive floor governors and also served as a member of the Bond Club of New York. He also chaired the NYSE Fallen Heroes Fund, which assists families of first responders killed in the line of duty. CNBC did not immediately respond to a Reuters request for comment. Maybe even challenge-for-downhill-wins fast. On a frigid Friday morning, Vonn darted through the shadows along the speed course at Copper Mountain and through the mist created by the snow makers. There was no clock at the bottom of the hill to measure just how speedy she was as she makes a comeback to skiing nearly six years removed from her last race. But she certainly looked the part of fast by dropping into a tuck position to become more aerodynamic, and even banging through a few gates on several high-speed runs. Vonn plans to enter a series of lower-tier FIS downhill and super-G races this weekend at Copper Mountain in an effort to gain the necessary results to lower her ranking so she can possibly enter World Cup races this season under a new wild-card rule. It could be the first step toward seeing her on the World Cup circuit again, maybe even on the podium. “I honestly think she will win,” retired ski racer Ted Ligety said in an interview with The Associated Press. “From what I’ve heard, she’s been kicking (butt) and been really fast in training. Some of the women on the World Cup are going to be rudely awakened to have to compete against a Lindsey Vonn again.” Vonn declined to talk after her practice session Friday. She chatted with several racers on the hill and again inside the lodge, where her dog, Lucy, became the center of attention. In a post Friday afternoon on Instagram, Vonn wrote : “Happy to be able to take another step this weekend! Technically tomorrow will be my first race but I’m using it as a training opportunity to keep on building. ... It’s been 6 years since I last raced so I still have a lot of equipment to test, finding my groove and really getting into racing form. I am having a lot of fun and want to keep on doing so!” When she left the sport, Vonn’s 82 World Cup race victories stood as the record for a woman and within reach of the all-time Alpine record of 86 held by Swedish great Ingemar Stenmark. The women’s mark held by Vonn was surpassed in January 2023 by Mikaela Shiffrin, who now has 99 wins — more than any Alpine ski racer in the history of the sport. Shiffrin is currently sidelined after a crash in a giant slalom event in Killington, Vermont, last weekend. The next World Cup races for the women’s circuit will be held in a week in nearby Beaver Creek, Colorado. There’s no timeframe for Vonn’s return to racing. Vonn’s last competition was in February 2019, when she finished third in a downhill during the world championships in Sweden. In a lot of ways, the three-time Olympic medalist stepped away still near the top of her game. But the broken arms and legs, concussions and torn knee ligaments took too big a toll and sent her into retirement. Last April, she had surgery for a partial knee replacement. She felt good enough to give it another go. Ligety, a two-time Olympic gold medalist, applauds her for her comeback bid. “It’s beyond my risk appetite, but it will be really fun to watch,” said Ligety, who’s covering the World Cup races in Beaver Creek this weekend for NBC. “She left at the top of her game, obviously, because of her knee injury. She probably felt like she got short-changed in her quest to take down Stenmark in wins, being only four away and her body failed her. “I can see how that would weigh on you. And then when you all of a sudden feel perfectly healthy again and you’re not that old, I can see giving it some ideas. I understand where she’s coming from and I think she has a good chance (to win races).” The aura of Vonn hovered around the bottom of the slope Friday. She had several pairs of Head skis all ready to try out. After each run — at least three — Vonn would huddle with her team, take a quick swig of water and head back up the lift. “She’s still super-fast,” fellow American teammate Keely Cashman said. “She’s been helpful talking to us about whatever we need. We’re excited to have her around.” What stands out about Vonn to Sophie Goldschmidt, the CEO of U.S. Ski and Snowboard, is the racer’s “strength of mind and attitude,” she said. “To be able to come back time and time again is very impressive. “We’re delighted that she’s rejoined the team,” Goldschmidt added. “Her achievements speak for themselves. She’s clearly one of the most decorated athletes in the U.S. and had an amazing ski racing career. So for her to feel fit and strong enough to want to give it another go, I think is quite remarkable. Former minister Madhukar Pichad, 84, passed away on Friday at a hospital in Nashik following a prolonged illness. Pichad, a prominent leader from the tribal community who represented Akole assembly constituency from 1980 to 2009, served as a minister in multiple Congress governments till 1995. He quit the Congress and joined Sharad Pawar's NCP in 1999. He also served as the tribal development minister in the Vilasrao Deshmukh-led government. In 2019, he and his son Vaibhav Pichad, a former MLA, switched loyalty to the BJP. Following his demise, Chief Minister Devendra Fadnavis said, “Senior BJP leader Madhukarrao Pichad's passing has caused the loss of a dedicated leader who tirelessly worked for the tribal community.” Deputy Chief Minister Eknath Shinde, expressed that the community had lost a great leader who fought for the rights of the tribal society. “Madhukar Pichad made significant contributions in the tribal areas. He consistently raised the issues of tribal people. He was always dedicated to ensuring employment opportunities for the tribal community,” he said. His career will always be remembered.”Danny Jansen’s stay with the Red Sox has proven brief. The former Red Sox catcher, who was acquired at the trade deadline from the Toronto Blue Jays this past summer, has agreed to a one-year, $8.5 million deal with the Tampa Bay Rays, according to multiple reports. He becomes the first Red Sox free agent to sign with another club this winter, and the Rays will be the third different AL East team Jansen has suited up for. Catcher Danny Jansen and the Tampa Bay Rays are in agreement on a one-year, $8.5 million contract that includes a mutual option for a second season, sources tell ESPN. Jansen, who has played in Toronto and Boston, remains in the AL East. Though he was an upgrade over McGuire, Jansen didn’t produce much, batting .188 with three home runs, six RBI and a .623 OPS in 30 games following his arrival. The most noteworthy aspect of his time in Boston came on Aug. 26, when he became the first player in MLB history to suit up for both teams in the same game. Jansen started at catcher for the Blue Jays in the clubs’ rain-suspended game on June 26, and by the time the game resumed two months later Jansen had been traded. Given Boston’s larger roster needs and the pending arrival of top catching prospect Kyle Teel, it wouldn’t have made sense for the Red Sox to bring Jansen back at the price he got from the Rays. Still, Jansen’s departure leaves the Red Sox with a void at catcher that will need to be addressed in the coming weeks. Connor Wong is the only catcher on the Red Sox’s 40-man roster. The long-term plan remains to eventually elevate Teel into a tandem with Wong, but given that the 22-year-old still has only 28 games at Triple-A under his belt, the club would likely prefer to bring in a veteran on a short-term deal who can hold down the fort until Teel is ready. Internally, the club doesn’t have many options. The best one right now is veteran journeyman Seby Zavala, who the Red Sox recently signed to a minor league deal. Zavala has played 194 games over five MLB seasons with the White Sox, Mariners and Diamondbacks, and his best season came in 2022, when he batted .270 with a .729 OPS in 61 games with Chicago. Last season Zavala appeared in 18 big league games with Arizona, batting .154 with a .496 OPS. Other than Zavala and Teel, Boston’s other internal candidates are Mickey Gasper and Nathan Hickey. Gasper has lately played primarily infield and did not record a hit in his 13-game big league cameo last fall, and Hickey played significant time at first base and DH last season and has yet to make his MLB debut. Even if most of the offseason’s biggest names remain unsigned, the market for catchers has proven quite active. In addition to Jansen, numerous other catchers who might have been candidates for Boston have already found homes for 2025. Among the notable names, Kyle Higashioka signed with the Rangers, Travis d’Arnaud with the Angels, Jacob Stallings with the Rockies and Austin Hedges with the Guardians. Some of the top remaining options include Carson Kelly, Gary Sanchez, Yasmani Grandal and James McCann, all of whom are right-handed hitting veterans coming off reasonably productive seasons who could slot into the role envisioned for Jansen. Another option is Martin Maldonado, who did not play the second half last season after being released by the White Sox but who has reportedly expressed a desire to play one more season. The 38-year-old is a complete non-factor offensively but has always been a standout on defense, and he could also provide valuable mentorship for Wong and Teel. Whoever the Red Sox add, it probably won’t be a big name. But even if it’s not as pressing a concern as upgrading the starting rotation or the club’s pursuit of Juan Soto, finding a serviceable stopgap who can give Teel the time he needs to develop will be a crucial item on Boston’s to-do list this offseason.

Thanks to a $13.4 million purchase, residents can expect a 300-acre park to roll out in north Fort Worth. During their Dec. 10 meeting, City Council members approved the purchase of 298.189 acres of land to become Tinsley Ranch Park. The park will be located at 3150 and 3450 Tinsley Lane, adjacent to Eagle Mountain Park and Eagle Mountain Lake. Funding for the parkland comes from loan repayments from park planning districts and the parks and recreation department budget. The eventual park is crucial to north Fort Worth as the growing city looks to balance conservation efforts with development, particularly in neglected regions of the city, said parks and recreation department spokesperson Karen Stuhmer in a statement. “This acquisition provides land for the development of future recreational opportunities and green space in an area identified as underserved in community parkland,” said Stuhmer. The purchase comes after City Council members also approved an expense of $3.9 million in a Nov. 19 meeting for more than 150 acres in west Fort Worth . That land is home to a cross timber forest and riparian and prairie ecosystems. Jaland Lowe flirted with a triple-double as Pitt improved to 6-0 with a 74-63 win over LSU on Friday afternoon at the Greenbrier Tip-Off in White Sulphur Springs, W.Va. Lowe finished with a game-high 22 points to go along with eight rebounds and six assists for the Panthers, who have won their first six games of a season for the first time since the 2018-19 campaign. It would have been the second straight triple-double for Lowe, who had 11 points, 10 rebounds and 10 assists against VMI Monday. Ishmael Leggett chipped in 21 points and Cameron Corhen supplied 14, helping Pitt outshoot the Tigers (4-1) 44.4 percent to 37.3 percent overall. Vyctorius Miller and Jalen Reed recorded 14 points apiece for LSU, with Reed also snatching seven boards. Cam Carter contributed 11 points. Pitt took control in the first four-plus minutes of the second half, opening the period on a 13-0 run to build a 40-28 lead. The Tigers were held scoreless following the break until Carter converted a layup with 13:13 to go. It was still a 12-point game after Zack Austin hit a pair of free throws with 12:50 remaining, but LSU then rallied. Corey Chest, Reed and Jordan Sears each had a bucket down low for the Tigers during an 8-1 spurt that made it 43-38. However, Lowe stemmed the tide, answering with back-to-back 3-pointers to put the Panthers up 49-38 with 9:31 left. McMullen signed her national letter-of-intent to the University of Illinois-Springfield softball team during a ceremony at Barry Western High School on Friday morning. "It was a long and rigorous recruitment process," said McMullen. "It was a lot of emails, a lot of going to camps and getting in touch with coaches. My mom helped out a lot." McMullen plans on majoring in speech therapy once enrolled at UIS. The decision to sign with UIS also keeps McMullen close to home. "I loved how small town it felt there," said McMullen. "It's a smaller D-II school, so I really loved how small and close to home it was. That way I'll still be able to come back and watch my younger sister play next year once she starts her high school career." McMullen's younger sister is in eighth grade and will start her high school career in the spring of 2026, but the elder McMullen has her senior season this spring to look forward to. McMullen will return as Western's leader this spring and its starting catcher. "My goal for us is to win a regional championship," said McMullen. "We have the team to do it this year. We have two really strong pitchers and we're going to have a really solid infield and outfield to back us up." During her time at Western, McMullen has also played volleyball and basketball. She was a first team All-State volleyball player this past fall. McMullen has also been a multiple-time All-Conference softball selection. Last season, she batted .396 with a .517 on-base percentage and .646 slugging percentage, while having a .984 fielding percentage behind the plate. McMullen has learned plenty from her various coaches at Western. "I learned to have fun and still be competitive with having fun," said McMullen. "Because sometimes that's something we forget about when we're in high pressure games. You just got to have fun."

Nearly half of all students who sat the Fiji Year Eight Examination this year failed, raising alarm bells among parents, teachers, and education stakeholders. Of the 19,300 plus registered students, the Ministry of Education recorded a 69 per cent pass rate, up just two per cent from 2023. This leaves more than 6000 students likely to progress to year nine, despite failing. Fijian Teachers Association general secretary, Paula Manumanunitoga, described the results as “close to pathetic”, urging all stakeholders to reassess and strategise. “From classroom teachers to ministry officials, everyone must take stock, analyse the issues, and implement countermeasures to improve outcomes next year,” he said. Mr Manumanunitoga criticised the lack of parental involvement, stating many parents fail to supervise or support their children’s education. “They should take their children’s education seriously and not treat it as trivial,” he said. The controversial no-repeat policy introduced by the previous government came under fire. Mr Manumanunitoga called for its removal, blaming it for advancing students unprepared for higher levels. “We have children who can’t read going to university. It must go,” he said. From 2019 to 2023, 5726 students dropped out before completing year 10, with another 4589 leaving before finishing primary school, according to ministry data. Curriculum Chaos Mr Manumanunitoga pointed to frequent curriculum changes as a significant issue, noting the confusion caused by multiple reforms in the past decade. “There have been at least three curriculums introduced by different ministers, and the constant changes are confusing for teachers,” he said. Prime Minister Sitiveni Rabuka also criticised the no-repeat policy, indicating plans to revisit it. PLEASANTON — Foster City police Chief Tracy Avelar is leaving the Peninsula to become Pleasanton’s new top cop, officials announced this week. Avelar, who joined the Foster City Police Department in 2002, will begin her new job in the Tri-Valley on Dec. 9. Mumbai/Ranchi, Nov 23: Maharashtra was coloured a vivid saffron on Saturday with voters giving the BJP-led Mahayuti alliance a landslide win over a tottering MVA while Hemant Soren’s JMM-led alliance stormed back to power in Jharkhand on Saturday for the second consecutive term. As votes were counted for the assembly elections in the two states, it was time for celebration in the BJP with the party poised to win 125 of the 149 seats it contested in the powerhouse state of Maharashtra. Together with its partners Shiv Sena and NCP, the ruling Mahayuti alliance could win 219 of the 288 seats in the state, leaving the Congress-Shiv Sena(UBT)-NCP(SP) tie-up with just 51 seats. As the opposition reeled under the impact of the decisive mandate against it in Maharashtra, Jharkhand offered some consolation with voters in both states going for continuity rather than change. “I thank everybody for this victory. We have such a big victory because of the work Mahayuti did. As there are many questions surrounding Mangione, one thing that has come up in his social media posts and talk with friends is that he played his share of games, including Among Us , the popular social deduction game that became a sensation during the pandemic, according to a report from NBC News on Tuesday. There is some attempt to connect the alleged assassination with the game that involved players killing each other, however, that connection is a bit silly. Among Us, a cartoon-styled social deduction party game, became popular with streamers and was played by millions worldwide during the COVID lockdown. A fellow student at the University of Pennsylvania told NBC News that Mangione was part of a group that played games together, and one of the games they played was Among Us. The individual found it "ironic" that Mangione was the suspect in the shooting of Brian Thompson considering the content of the game. "I just found it extremely ironic that, you know, we were in this game and there could actually be a true killer among us," Alejandro Romero told NBC News. The official Among Us X account posted on Tuesday what seemed to be a response to the report that simply said, "Um..." um Among Us is a social deduction game where players have to identify imposters before they kill their crewmates on a virtual spaceship. NEW YORK (AP) — U.S. stock indexes drifted lower Tuesday in the runup to the highlight of the week for the market, the latest update on inflation that’s coming on Wednesday. The S&P 500 dipped 0.3%, a day after pulling back from its latest all-time high . They’re the first back-to-back losses for the index in nearly a month, as momentum slows following a big rally that has it on track for one of its best years of the millennium . The Dow Jones Industrial Average fell 154 points, or 0.3%, and the Nasdaq composite slipped 0.3%. Tech titan Oracle dragged on the market and sank 6.7% after reporting growth for the latest quarter that fell just short of analysts’ expectations. It was one of the heaviest weights on the S&P 500, even though CEO Safra Catz said the company saw record demand related to artificial-intelligence technology for its cloud infrastructure business, which trains generative AI models. AI has been a big source of growth that’s helped many companies’ stock prices skyrocket. Oracle’s stock had already leaped more than 80% for the year coming into Tuesday, which raised the bar of expectations for its profit report. In the bond market, Treasury yields ticked higher ahead of Wednesday’s report on the inflation that U.S. consumers are feeling. Economists expect it to show similar increases as the month before. But ultimately, Ole Miss is not set to miss the Playoff because it lost Saturday to Florida. It’s probably going to be left out because it lost at home to Kentucky, way back in September. Therein lies the ultimate lesson about the new world of the Playoff, what it takes and why Kiffin and his program didn’t have it this season. Ole Miss wasn’t that team this year. But a good example of that is the team Ole Miss beat two weeks ago: Georgia . Kirby Smart’s team looked overmatched in Oxford on both sides of the ball. It looked physically beat up and mentally tired from a schedule rated the hardest in the country entering this weekend by ESPN and two other computer models. But as bad as the Bulldogs looked in that game, they still have only two losses and are still alive in the Playoff chase. Georgia, for all its warts, including the 18-point loss in Oxford, is on the verge of making the Playoff because it won enough big games — Texas, Clemson , Tennessee — and because when it had its come-to-Jesus game at Kentucky, it won it. Just like it survived Florida, which is improving each week, as the Rebels are painfully aware. And Georgia, just to be sure, still needs to beat Georgia Tech next week. But both teams have losable games next week, and here’s another illustration of how the game has changed in the bigger and harder SEC: Nobody is absolutely, safely in the Playoff yet. The only one-loss team is Texas , which has no ranked wins and would be sweating it if it loses at Texas A&M next week. Alabama , Georgia and now Tennessee may be on the right side of the bubble, but one loss between now and the SEC championship may change that. Oh, and about the SEC championship: Kiffin set himself up for a karmic fall this week when, in his usual admirable honesty, he said he and other coaches wanted to avoid playing in the SEC championship. Get that week off to rest up and not risk a loss that could cost them Playoff seeding or even a Playoff spot. Well, that’s not an issue for the Rebels anymore. This team is good enough to win the whole thing. It has an elite defensive front, elite receivers and a quarterback in Jaxson Dart who often has looked elite this year — but not the final few minutes of the debacle in Gainesville. Kiffin will be dinged again for not having what it takes ... again. That’s still premature. Kiffin is struggling to close the deal as a coach, but he keeps getting close. He has matured from the coach who talked too much at Tennessee, got fired on the tarmac at USC and wore out his welcome at Alabama. Set aside his past, and there’s a great offensive mind and program-builder, and he’s still only 49 years old. Advertisement There’s still a chance of something great happening for Kiffin, and it could still be at Ole Miss, which has a collective head Walker Jones who has made it clear the offseason spending push was about trying to capitalize and then sustain and not about 2024-or-bust. It doesn’t look like it worked for this year. So it’ll be back to the transfer portal this offseason, and questions will continue about whether that’s truly the best model. They’ll also continue about Kiffin. The jury remains out on that. What is clear is that for all the talk that the expanded Playoff will devalue the regular season, it’s harder to make it than many thought. There are a lot of good teams. But there are still some mediocre teams too. And there’s a lesson that Kiffin, Ole Miss and every contender can take: don’t lose to Kentucky . "We're really in this for the long haul," Orefice said. "So we're not looking at it on a one-year basis." Rick Giles is president of the Gazelle Group, which also operates several similar events, including the College Basketball Invitational. He was skeptical the financial numbers would work. Giles said in addition to more than $8 million going to the players, there were other expenses such as the guarantees to the teams. He said he didn't know if the tournament would make up the difference with ticket sales, broadcast rights and sponsorship money. The top bowl of the MGM Grand Garden Arena will be curtained off. "The math is highly challenging," Giles said. "Attendance and ticket revenues are not going to come anywhere close to covering that. They haven't announced any sponsors that I'm aware of. John said he discovered them recently. He’s not a fan of football. He knew nothing about the history of bowl games in New York. John began to learn about the programs, he said, only after he listed the first one for a much lower price than $10,000. Romania's domestic intelligence service says there are signs the effort was "co-ordinated by a state-sponsored actor". Calin Georgescu, a far-right Nato-sceptic who has previously praised Vladimir Putin, was almost unknown in Romania until he won the first round of voting in the presidential elections two weeks ago. Now Romanian intelligence says his sudden and surprise surge in popularity is down to a "highly organised" and "guerrilla" campaign on social media, sharing identical messaging and using influencers. They say it was conducted from "external locations" to bypass controls. A separate intelligence assessment says that Romania has been identified as an "enemy state" by Moscow and a priority target for what it calls "aggressive hybrid actions". The politically explosive information – which has landed just days before the second round of voting - comes from declassified documents published this evening by the outgoing president, Klaus Iohannis. They reveal how paid content supporting Georgescu was promoted on TikTok, without being marked as election campaigning – in violation of the platform’s own rules and of Romanian electoral law. Other candidates’ content was subject to closer controls. Georgescu has always said he spent "zero" on election promotion, denying he was even campaigning. But the intelligence documents identify one TikTok account which they say made payments of $381,000 (£299,819; €361,872) in just one month from 24 October – to users who were promoting Georgescu. Georgescu claims the release of the documents is a coordinated attempt to block his candidacy. “I think it’s the first time in the history of the world when a state is organising an action against a candidate to stop him from running,” he said in a TV interview on Wednesday. He also denied knowing any of the influencers or funders mentioned in the reports. The documents released in this highly unusual move were all papers drawn up for a meeting of the security council following the first round of the presidential election. They also reveal that access data for electoral websites was stolen from legitimate users and published online “on cyber-crime platforms originating from Russia”. Separately, the intelligence agencies report some 85,000 attempted hacks in an attempt to access electoral data and change content – including on election day. The report says the cyber-attackers used advanced methods to remain anonymous, working in a way and on a scale "typical of state-sponsored actors". An investigation is ongoing to discover who was responsible and whether there was any impact on the election. Russia has denied any interference in Romania's election process. Far-right frontrunner Georgescu is due to face reformist candidate Elena Lasconi in a second round vote on Sunday. Romanian Prime Minister Marcel Ciolacu – who came 3rd in the presidential race – has now announced he will "fully endorse" Elena Lasconi. But that’s assuming the vote goes ahead. The prosecutor’s office is now examining the new documents. "I hope that, based on the evidence published today, the state authorities will take appropriate action, and all those responsible will be held accountable," Ciolacu said. He added that people's votes have shown they want the "continuation of Romania's European development path". A pro-EU protest has been called for Thursday evening. Commenting on the protest, Georgescu warned against possible unrest, citing the "Maidan" in Ukraine - the revolution of 2014 that ousted a pro-Russian president. An attorney for the counties called the decision “devastating.” Justices were largely unanimous in their interpretation of an arcane disagreement over the state law, which had emerged in a lawsuit brought by Lake and Trumbull counties outside Cleveland against CVS, Walgreens and Walmart. The counties won their initial lawsuit — and were awarded $650 million in damages by a federal judge in 2022 — but the pharmacies had disputed the court's reading of the Ohio Product Liability Act, which they said protected them from such sanctions. In an opinion written by Justice Joseph Deters, the court found that Ohio state lawmakers intended the law to prevent “all common law product liability causes of action" — even if they don't seek compensatory damages but merely “equitable relief” for the communities. “The plain language of the OPLA abrogates product-liability claims, including product-related public-nuisance claims seeking equitable relief,” he wrote. “We are constrained to interpret the statute as written, not according to our own personal policy preferences.” Two of the Republican-dominated court's Democratic justices disagreed on that one point, while concurring on the rest of the judgment. “Any award to abate a public nuisance like the opioid epidemic would certainly be substantial in size and scope, given that the claimed nuisance is both long-lasting and widespread,” Justice Melody Stewart wrote in an opinion joined by Justice Michael Donnelly. “But just because an abatement award is of substantial size and scope does not mean it transforms it into a compensatory-damages award.” In a statement, the plaintiffs' co-liaison counsel in the national opioid litigation, Peter Weinberger, of the Cleveland-based law firm Spangenberg Shibley & Liber, lamented the decision. “This ruling will have a devastating impact on communities and their ability to police corporate misconduct," he said. “We have used public nuisance claims across the country to obtain nearly $60 billion in opioid settlements, including nearly $1 billion in Ohio alone, and the Ohio Supreme Court’s ruling undermines the very legal basis that drove this result.” But Weinberger said Tuesday's ruling would not be the end, and that communities would continue to fight “through other legal avenues.” "We remain steadfast in our commitment to holding all responsible parties to account as this litigation continues nationwide,” he said. In his 2022 ruling, U.S. District Judge Dan Polster said that the money awarded to Lake and Trump counties would be used to the fight the opioid crisis. A jury returned a verdict in favor of the counties in November 2021, after a six-week trial. It was then left to the judge to decide how much the counties should receive. He heard testimony the next May to determine damages. The counties convinced the jury that the pharmacies played an outsized role in creating a public nuisance in the way they dispensed pain medication. It was the first time pharmacy companies completed a trial to defend themselves in a drug crisis that has killed a half-million Americans since 1999.
